ARTICLE 1: Application of Terms and Conditions
These Terms and Conditions apply to every agreement between dd103 and its customers. By placing an order, the customer agrees to be bound by these Terms and Conditions. We reserve the right to change these Terms and Conditions, and the most recent version will always apply to the agreements. Unless dd103 has indicated otherwise in writing to the customer, the customer’s own general terms and conditions shall not be accepted.
ARTICLE 2: Products
We sell handmade jewellery made of either sterling silver, 14-carat solid gold, and other materials mentioned. Product details, including prices, are provided in our web shop.
ARTICLE 3: Payment
The total price of the products including VAT is indicated in our web shop. Payment methods include but are not limited to: iDeal, Visa, Mastercard, Maestro, American express, and Google + Apple Pay. Shipping costs are additional and will be calculated at checkout.
ARTICLE 4: Delivery
dd103 objects are crafted by hand and in most cases made-to-order. To allow ourselves a smooth and efficient production experience it can take up to 7 business days for your order to be shipped out from the studio.During periods of high demand or unforeseen circumstances we reserve the right for any possible delays.
Products will be shipped to the address provided by the customer during the order process. When your order is dispatched we notify you through email with a tracking number. Once an order has been shipped the destination cannot be changed. Delivery times and shipping costs vary depending on the destination. We are not responsible for delays caused by the shipment carrier or customs clearance. All shipments are carried by PostNL and their international partners
Please note that we cannot be held accountable for any loss or damage that occurs during the shipment process. Our responsibility ends once a parcel is handed over to the carrier. If you have opted for insured shipping and the carrier confirms that the parcel has gone missing, dd103 will supply the necessary information to the carrier to initiate the refund process. The duration of this process is beyond our control.
ARTICLE 5: Customs, Duties, and Taxes
The customer is responsible for ensuring the lawful import of products to their destination country. Import taxes, customs duties, and fees are the customer's responsibility and are not controlled by dd103.
ARTICLE 6: Right of Withdrawal and Returns
Customers may return unworn products within 14 days of receipt. To initiate a return, the customer must notify dd103 (info@dd103.nl) for further instructions. Please ensure that any returned items are postmarked within 14 days from the date of delivery. We strongly recommend using recorded delivery when returning your order. We cannot be held liable for any loss or damage that occurs during the return shipment process. Additionally, please note that we are unable to refund international duties and taxes, as these payments were not made to dd103. For assistance with reclaiming these charges, we encourage you to contact your local customs authority.
Custom-made jewellery, sale items, and solid gold jewellery cannot be returned. Returns must include all original packaging and be in original condition. Refunds are processed within 3 to 7 business days after the product passes quality inspection. Return costs are the customer's responsibility, and shipping fees are non-refundable.
ARTICLE 7: Product Warranty
Our objects come with a 3 month warranty covering defects due to workmanship. The warranty does not cover damage caused by misuse, negligence or normal wear and tear. Proof of purchase is required for warranty claims. If a product is non-compliant, we will offer a replacement or refund.
ARTICLE 8: Privacy
We collect personal information necessary for processing orders and delivering products. This includes information provided during registration and ordering. ARTICLE 9: Intellectual Property
All intellectual property rights, including copyrights, logos, and trademarks, on our texts, photos, images, and other materials are owned by dd103 or used with permission. Customers may not infringe on these rights.
ARTICLE 10: Complaints Procedure
Customers may send complaints to info@dd103.nl, which will be processed within five working days. If more time is needed, we will inform the customer of the expected response time. Disputes that cannot be resolved will be subject to dispute resolution as outlined below.
ARTICLE 11: Dispute Resolution
These Terms and Conditions and all agreements with customers are governed by Dutch law. Any disputes will be resolved by the competent court in Amsterdam.
ARTICLE 12: General Provisions
We may change these Terms and Conditions from time to time. Continued use of our website following such changes constitutes acceptance of the new terms. We reserve the right to change, move, or delete portions of our website as necessary.
